By accessing or using the Fortify Funding website, or by submitting an application or request through it, you agree to be bound by these Terms of Service and by our Privacy Policy. If you do not agree, do not use the site.
02What Fortify does
Fortify Funding arranges business financing by connecting business owners with third-party funding partners. We are a broker, not a lender. We do not make credit decisions, set the terms of any financing, or provide the funds. Decisions about whether to offer financing, and on what terms, are made solely by the funding partners.
03Eligibility
You must be at least 18 years old, authorized to act on behalf of the business you are applying for, and using our services for business and commercial purposes only. Our services are not offered for personal, family, or household financing.
04Applications and information you provide
You agree that the information you provide is accurate, current, and complete, and that you are authorized to share it, including any business financial documents. Providing false or misleading information may result in denial of financing and may be unlawful. You are responsible for the information submitted under your application.
05Consent to be contacted
By submitting your information and checking the consent box on our form, you provide express written consent to receive calls and text messages from Fortify Funding at the number you provide, including through automated technology, regarding business financing. Consent is not a condition of any purchase or of receiving financing. Message and data rates may apply, and message frequency varies. You may opt out of texts by replying STOP. See our Privacy Policy for details on how we handle your information.
06No guarantee of financing
Submitting an application does not guarantee that you will be approved for or offered any financing. Funding amounts, rates, factor rates, fees, terms, and timing are determined by the funding partners and are not guaranteed by Fortify. Any figures, ranges, or timeframes shown on our site are illustrative and typical for complete files; your actual offer may differ or may not be available at all.
07Third-party funding partners
Financing is provided by third parties, not by Fortify. Your relationship with a funding partner, including any agreement you enter into with them, is governed by that partner's own terms and disclosures. You are responsible for reviewing and understanding those terms before you sign. Fortify is not a party to, and is not responsible for, the financing agreement between you and a funding partner.
08Acceptable use
You agree not to use the site to violate any law, infringe anyone's rights, submit false information, interfere with the site's operation, attempt to gain unauthorized access, or use automated means to scrape or overload the site.
09Intellectual property
The site and its content, including text, graphics, logos, and design, are owned by Fortify Funding or its licensors and are protected by intellectual property laws. You may not copy, reproduce, or create derivative works from the site without our permission.
10Disclaimers
The site and services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Fortify does not warrant that the site will be uninterrupted, error-free, or secure. Nothing on the site is legal, tax, accounting, or financial advice.
11Limitation of liability
To the fullest extent permitted by law, Fortify Funding and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business, arising out of or related to your use of the site or services. Our total liability for any claim relating to the site or services will not exceed one hundred dollars ($100).
12Indemnification
You agree to indemnify and hold harmless Fortify Funding from any claims, damages, losses, and expenses, including reasonable attorneys' fees, arising out of your use of the site, your submission of information, or your violation of these terms.
13Governing law and disputes
These terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute relating to these terms or the site will be resolved in the state or federal courts located in Florida, and you consent to their jurisdiction, unless otherwise required by applicable law.
14Changes to these terms
We may update these Terms of Service from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the site after changes take effect means you accept the revised terms.
